At approximately 11:14 p.m., Deputy Guerrero was dispatched to a disturbance with a weapon call near the 6800 block of Avenue C. The reportee stated that they heard about seven gunshots right outside of their residence and that there was a truck parked outside. Deputy Guerrero arrived on scene and spotted the truck with a male suspect inside of it. The suspect was given commands to turn off his truck and raise his hands outside of the vehicle window. The suspect turned the vehicle off but did not comply with commands to raise his hands out of the window. A neighbor warned Deputy Guerrero that the suspect had a shotgun inside of the vehicle.
The suspect turned his vehicle back on and started driving away from the scene. While fleeing the scene, the suspect nearly struck multiple vehicles and rammed into a metal fence. Deputies conducted a felony traffic stop on the vehicle and attempted again to have the suspect lower the window and show his hands. After refusing to comply, deputies removed the suspect from the vehicle and gave commands for him to place his hands behind his back. The suspect was tased after he refused to comply. Deputies were able to detain the suspect and placed him in the back seat of the patrol vehicle.
Deputy Harris located a 12 gauge shotgun on the floorboard of the suspect’s vehicle along with 19 spent shotgun shells.
At the original scene deputies located two windows that had been shot out near the 6800 block of Avenue C. One of the windows that was shot out was located directly above the complainants’ bed. The District Attorney’s Office accepted charges for 3rd Degree Felony Deadly Conduct and 3rd Degree Felony Evading.
