At approximately 2:43 p.m., Deputy Garcia and Deputy Ipina were conducting bicycle patrol on the Harrisburg bike trail when they observed two males loitering on the trail with an alcoholic beverage. Deputies approached the two males and could also smell Marijuana emitting from their persons. Deputies observed a handgun in plain view, sticking out of the waistband of one of the suspects. Deputy Garcia attempted to detain the male at which time the male suspect fled on foot. Deputies caught up to the suspect, disarmed him, and detained him. The second male was also detained while further investigation was conducted.
The suspect that fled on foot from deputies was found to have a warrant out of Harris County Sheriff’s Office. The handgun that deputies recovered came back as stolen. Deputies also found 39 Xanax pills in the male’s backpack and an additional magazine for the handgun.
The District Attorney’s Office accepted a charge for Possession of a Controlled Substance along with Unlawful Carry of a Weapon on the suspect. The charge was later enhanced to Theft of a Firearm. The second male was released on scene.
